To participate in these drawings, entrants must completely understand and unconditionally agree to these official rules, terms and conditions:
[ Use of collected data ]Names, E-mail addresses and physical mail addresses sumbitted for this contest will not sold or distributed to anyone. Participants give permission to be contacted by e-mail regarding their entry or award in this contest. Winners consent to the use of their name and general geographic location for promotional purposes on the Flash Silvermoon's web sites without additional compensation (example: Jane Doe of Atlanta, Georgia) [ Odds of Winning ]The odds of winning this contest are indeterminate and depend upon the number of valid entries received each month. [ Prize ]This contest gives entrants the chance to win a copy of "The Wise Woman's Tarot - Book and Deck" by Flash Silvermoon. Value $50.00 (U.S.) No prize substitutions, redemptions or transfers allowed. The prize is not redeemable for cash, credit or other merchandise. Expenses assosiated with the prize that not specifically stated are the sole responsibility of winner, including any applicable taxes. [ Prize Drawing - Selection ]One prize will be awarded each month in a random drawing to be held from all eligible entries received by Flash Silvermoon whose decisions are final and binding in all matters relating to this contest. Prize winner will be notified by e-mail within two days after the drawing. E-mail address must be valid at the time of award confirmation. Winner must respond within one week (7 days) to be awarded the prize. Prize winner will allow two to four weeks for delivery. Flash Silvermoon will pre-pay for shipment to the winner, and will choose the delivery method for the prize. If the winner does not respond to notification of the prize award within one week (7 days) of notification, the prize will be forfeited and another winner will be chosen at random for that month. [ When to Enter - Timing ]A new contest begins each month. Each contest begins at 12:00:01 a.m. Eastern Standard Time on the first of each month and ends at 12:00:00 a.m. Eastern Standard Time on first of the following month. All correctly completed entries received online as of the monthly closing date and time will be included in that month's random drawing. [ Where to Enter ]Internet entry can only be made by the entrant, only at the authorized website address of www.flashsilvermoon.com/contest.htm Entries made by any other individual or any entity and/or originating at any other Internet website or e-mail address, including, but not limited to, commercial contest subscription notification and/or entering service sites, will be declared invalid, and as such, ruled ineligible for this contest. [ Who May Enter - Eligibility ]There is no purchase necessary in order to receive a chance for this drawing. To be eligible to enter this contest, an entrant must be 18 years of age or older and a legal resident of the continental United States of America, or the District of Columbia, at time of contest entry. Each contestant is limited to one entry per monthly contest. If evidence exists of any duplicate entries, that person will be disqualified from that and any future drawings. Previously winning entrants are NOT allowed to participate in any future drawings. An entrant can receive a prize only once per lifetime. Duplicate entries will result in forfeiture of contest for that entrant. This contest is void where prohibited or restricted by federal, state or local laws and all Federal, state and local laws and regulations apply. Employees, affiliates and contractors of Flash Silvermoon and Moonfox Productions, are not eligible, nor are members of these employees' families (defined as parents, children, siblings, spouse and life partners). [ How to Enter ]Fill out the entry form at the webite address of www.flashsilvermoon.com/contest.htm and press "submit entry". All entries must be completely filled out, incomplete entries will be disqualified. Limit one (1) entry per person per month per household. The e-mail address given on the entry form MUST be valid. More than one (1) entry from any person or from any e-mail address will void all entries from that person or e-mail address, as applicable. Any attempt by a person to enter more than once with multiple email accounts may result in disqualification at the discretion of Flash Silvermoon. Flash Silvermoon is not responsible for lost, late, incomplete, garbled, illegible, or misdirected contest entries, or for any error, human, technical or otherwise, which may occur in the processing of contest entries. Proof of sending will not be deemed to be proof of receipt. Entries will not be acknowledged. Any use of robotic, automatic, programmed or similar entry methods will void all such entries by such methods. [ Special Conditions, including Internet Issues ]Where a dispute arises about who submitted an on-line entry, the entry will be deemed submitted by the authorized holder of record of the e-mail account. If technical difficulties compromise the integrity or ability to continue on-line entry, including but not limited to viruses, bugs, non-authorized human intervention or other causes beyond the control of Flash Silvermoon which corrupts or impairs the administration, security, fairness or proper play of the contest, Flash Silvermoon reserves the right to suspend or terminate the contest. Persons found tampering with or abusing any aspect of this contest will be disqualified. Any attempt by anyone to deliberately damage or tamper with this website or undermine the legitimate operation of the contest may be a violation of criminal and civil laws and should such an attempt be made, Flash Silvermoon reserves the right to seek damages from any such person to the fullest extent permitted by law. Flash Silvermoon is not responsible for any problems or other error of any kind whether human, mechanical or electronic, technical malfunction of any telephone network or lines, computer online systems, servers, access providers, computer hardware, software, failure of any entry not received due to technical problems, jumbled, scrambled or misdirected transmissions, or congestion on the Internet or any website, or any combination thereof including any injury or damage to any entrant's personal computer related to or resulting from drawing participation, entry submission, or downloading of any materials related to this contest. [ General Conditions ]Flash Silvermoon reserves the right to modify or cancel this contest without any prior notice. All decisions of Flash Silvermoon relating to the contest are final. Flash Silvermoon expressly disclaims any responsibility and liability for lost entries and for injury and loss to any person or property relating to the delivery and use or misuse of any of the prizes awarded. By accepting a prize, winners agree that Flash Silvermoon and any of its advertising and promotion agencies have no liability whatsoever for, and will be held harmless by winner against, any injuries, losses or damages of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of a prize or participation in this contest. By participating, except where legally prohibited, winners grant permission for Flash Silvermoon to post winners' names on the Flash Silvermoon website. This contest shall be governed by the laws of the State of Florida, and participants in the contest hereby consent to the exclusive jurisdiction and venue of Florida courts (state and federal) for any causes or controversies arising out of the contest. Each participant waives any and all objectives to jurisdiction and venue in these courts. [ Arbitration: ]Except where prohibited, entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this contest, or any prizes awarded, other than the administration of contest or the determination of winners shall be resolved individually, without resort to any form of class action, and exclusively by arbitration to be held in the state of Florida under the Commercial Arbitration Rules of the American Arbitration Association. Participants hereby waive all rights (i) to claim, or to be awarded, punitive, direct, indirect, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses; and (ii) to have damages multiplied or otherwise increased. |
